Resolution of the Association of Prosecutors Lex Super Omnia

The prosecution service in Poland has become a political tool in the hands of the Minister of Justice – Attorney General; to a large extent it is aimed at pursuit of the government party’s interest and at the personal goals of Attorney General by means of influence over the proceedings, and resulting in:

  • Over-exposure of proceedings pertaining to political opponents and to civic activities critical of the authorities, while failing to prosecute individuals who commit unlawful acts in governmental structures and in state-owned enterprises;
  • Lack of firm, uniform response to manifestations of discrimination, xenophobia and expressions of hatred;
  • Engaging in matters that the Attorney General, as a party to proceedings, has, or can have, personal interest in;
  • Propaganda deployment of the prosecution service to establish the political position of the Attorney General.
