Brief of the Helsinki Foundation for Human Rights on the context of changes and the role of the Supreme Court under the Polish Constitution
On 12 July 2017, the group of MPs submitted to the Parliament the draft law amending the Act on the Supreme Court. One of the most controversial provisions of the draft law states that all tenures of judges sitting currently in the Supreme Court will be terminated on a day of the Act’s coming into force. In the light of the draft, the new judges of the Supreme Court will be selected by the National Council of the Judiciary in Poland.
